The paper discusses practices of schools in dealing with companies whose digital services are used in schools in Austria. The focus is on data protection and the right to freedom of contract. In view of current practices and data protection agreements, the need for improvement is identified and it is recommended that both schools and guardians do not unquestioningly consent to the processing of children's data by third parties. It is necessary that both the contracts with commercial providers and the data protection statements are presented to guardians before using the service, which starts with the creation of identifiers.
